    November 28, 2019 - The UCP government is holding its Annual General Meeting on Saturday, November 30, 2019, in Calgary, at The Westin Calgary Airport. And outside, union and non-union workers alike will be protesting to say NO to austerity measures, NO to broken promises and NO to attacks on democracy from the UCP government.

    When: Saturday, November 30, 2019 – From 11:00 am to 2:00 pm MST

    This is a non-partisan rally, inviting all peoples, all groups and all unions to support Alberta moving forward and finding solutions while protesting the current provincial government.

    Le 27 novembre 2019 - Comme nous en avions précédemment informé les membres, le syndicat a déposé des griefs en 2013 et 2014, affirmant que les représentants Concierge avaient été sous-payés par Telus en raison d’une mauvaise classification de leur salaire pour leur poste. En décembre 2018, le syndicat a obtenu gain de cause lors d’un arbitrage, et l’arbitre a ordonné à Telus d’indemniser les anciens agents Concierge au taux de rémunération approprié.

    Cependant, un obstacle majeur s’est opposé au versement des sommes dues aux agents affectés lorsque Telus a décidé qu’il était dans son bon droit de réviser rétroactivement les sommes versées aux anciens agents Concierge dans le cadre du programme d’encouragement des ventes (SIP). Telus prétend à présent pouvoir payer le SIP à un niveau inférieur à celui qui était originellement prévu, prétextant que si la compagnie avait initialement payé aux agents concernés ce taux de rémunération plus élevé attribué par l’arbitre aux agents, leur SIP aurait été calculé différemment et à un taux beaucoup plus bas.

    La position de la compagnie est qu’elle peut désormais faire une retenue sur le SIP réellement payé aux agents concernés et calculer celui-ci à un taux inférieur, réduisant ainsi les arriérés de paiement dus à ces agents tels que définis par la sentence.

    Le syndicat estime que cela est injuste et qu’aucune réduction du SIP par l’employeur ne peut être justifiée. Nous voulons nous assurer que les membres reçoivent chaque centime qui leur est dû suite au sous-paiement de leur travail par Telus, incluant une rectification salariale intégrale, ce qui aura pour conséquence d’augmenter les cotisations de retraite, les heures supplémentaires et les actions, le cas échéant. Malheureusement, pour défendre notre position, nous devons renvoyer la question de l’indemnisation à l’arbitre afin qu’il puisse décider si la sentence exige le paiement ou si elle permet à Telus de récupérer une partie du SIP touché par les anciens agents Concierge. 

    Nous avons travaillé d’arrache-pied en coulisses pour tenter de faire verser aux membres le remboursement final qui selon nous a été déclaré dû par la sentence. Il est malheureux que l’employeur continue de faire traîner les choses en longueur. Nous n’avons pas d’autre choix que de nous en remettre de nouveau à l’arbitre afin obtenir une décision sur la question de cette retenue sur le SIP.

    November 27, 2019 - As we have communicated to members previously, the Union filed grievances in 2013 and 2014 asserting that “Concierge” Reps had been underpaid by Telus due to an incorrect wage categorization of their job. In December 2018, the Union won this grievance at arbitration, and the arbitrator ordered Telus to compensate former Concierge agents at the proper wage rate.

    However, a major stumbling block in getting affected agents their money emerged when Telus took the position that they could retroactively revise the monies paid to former Concierge agents under the Sales Incentive Program (SIP). Telus claims that they can now pay SIP at a lower level than they actually paid it on the basis that if they had originally paid affected agents the higher wage rate that the arbitrator said agents were owed, their SIP would have been calculated differently and at a much lower rate.

    The position the Company takes is that they can now claw back the SIP actually paid to affected agents and calculate it at a lower rate, thus reducing the back pay owed to these agents under the award.

    The Union believes this is wrong and that no employer clawback of SIP can be justified. We want to ensure that members receive every penny that they are owed as a consequence of Telus’ underpayment of their work, including full wage correction, and the effect that these additional wages would have on additional pension contributions, overtime and shares where applicable. Unfortunately, to fight for our position, we must take the issue of compensation back to the Arbitrator to make a ruling on whether the award mandates, or allows, Telus to clawback any portion of the SIP earned by former Concierge agents.

    We have been working very hard behind the scenes trying to get members the proper pay-out that we believe the award has declared they are owed. It is unfortunate that the Employer continues to drag this out. We have been left with no choice but to return to the Arbitrator to obtain a decision on the issue of a SIP clawback.
