October 21, 2021 - The Union is very happy to announce that after an eight (8) year fight we have won an arbitration worth hundreds of thousands of dollars, one of the largest damage awards against Telus in our Union's history!
The fight started when Telus created a new work group called Concierge, that included members in BC and Alberta. These members were doing the work of a new job that was not evaluated to determine fair compensation, which is a breach of the collective agreement. We grieved this in 2013 and 2014. Arbitrator Sullivan stated in the original award: “This group of employees is doing all the work that would have previously been performed by six employees and three different job classifications, one of which was a quasi-job classification.”
As it was awarded on December 14, 2018, those agents should have been paid Group E wages in the same manner of Loyalty & Retention agents. When it came to paying out those funds to the approximately 195 agents, Telus argued that SIP (sales incentive) payments would need to be deducted as Concierge had a different (higher) SIP than Loyalty & Retention.
Your Union didn’t agree with that position and fought hard against it. We went back before the Arbitrator in March 2020, as we couldn’t reach agreement on the payout calculations and have been waiting for a ruling.
At long last, the Arbitrator has agreed with the Union “the SIP monies paid in the present case constitute an earned benefit for performing work for the Company, and do not resemble an indemnity program or compensating advantage that can properly be used to offset a remedial damage claim.”
The retroactive difference between wages of Wage Groups D and E for the affected employees for the period of question totals $742,167.48. From this amount, the Company had deducted enhanced SIP payments that exceed Loyalty & Retention SIP and has arrived at a total amount owed of $303,169.60.
Because of this win, the full $742,167.48 is ordered to be paid!

Le 21 octobre 2021 - Le Syndicat est très heureux d’annoncer qu’après un combat de huit (8) ans, nous avons remporté un arbitrage d’une valeur de centaines de milliers de dollars, l’une des plus grosses victoires pour dommages contre Telus dans l’histoire de notre Syndicat !
Le combat a commencé lorsque Telus a créé un nouveau groupe de travail appelé Concierge, qui comprenait des membres de la Colombie-Britannique et de l’Alberta. Ces membres faisaient le travail d’un nouvel emploi qui n’avait pas été évalué pour déterminer une juste rémunération, ce qui constitue une violation de la convention collective. Nous avons déposé un grief en 2013 et 2014. L’arbitre Sullivan a déclaré dans la sentence initiale : « Ce groupe d’employés effectue tout le travail qui aurait été auparavant effectué par six employés et trois classifications d’emploi différentes, dont l’une était une quasi-classification d’emploi ».
Comme le mentionne la décision arbitrale du 14 décembre 2018, ces agents auraient dû recevoir les salaires du Groupe E de la même manière que les agents de Rétention et fidélisation. Lorsqu’il s’agissait de verser ces fonds aux quelque 195 agents, Telus a fait valoir que les paiements SIP (incitatifs de vente) devraient être déduits, car Concierge avait un SIP différent (plus élevé) que Rétention et fidélisation.
Votre syndicat n’était pas d’accord avec cette position et s’y est battu avec acharnement. Nous sommes retournés devant l’arbitre en mars 2020, car nous ne pouvions pas parvenir à une entente sur les calculs de paiement et nous étions en attente d’une décision.
Enfin, l’arbitre a convenu avec le syndicat que « les sommes des SIP versées dans le cas présent constituent un avantage acquis pour l’exécution d’un travail pour la compagnie et ne s’apparente pas à un programme d’indemnisation ou à un avantage compensatoire pouvant être utilisé à bon escient pour compenser une réclamation suite à un recours pour dommage réparateur ».
La différence rétroactive entre les salaires des Groupes de salaire D et E pour les employés affectés pour la période en question s’élève à 742 167,48 $. De ce montant, la compagnie avait déduit les paiements SIP améliorés qui dépassaient le SIP de Rétention et fidélisation et est arrivé à un montant total dû de 303 169,60 $.
En raison de cette victoire, le montant total de 742 167,48 $ doit être payé !

Cette victoire n’aurait pu être possible sans la mobilisation des membres et le travail acharné des Représentants de la Section locale et des délégués syndicaux dévoués.
