THESE RULES ARE THE TERMS AND CONDITIONS APPLICABLE TO THE CONTEST ADMINISTERED BY THE TELECOMMUNICATIONS WORKERS UNION (TWU), UNITED STEELWORKERS LOCAL UNION 1944 (“USW LOCAL 1944”). THE CONTEST IS INTENDED TO BE CONDUCTED IN THE PROVINCES OF ALBERTA, BRITISH COLUMBIA, ONTARIO, QUEBEC AND SASKATCHEWAN ONLY, AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. 1. ELIGIBILITY.
To be eligible to enter the Contest, an individual must: - be a legal Canadian resident of, and the age of majority in, Canada; - be a USW Local 1944 member in good standing; - be the sole owner of all right, title and interest (including copyright) in and to the Picture(s) (as defined below) submitted in connection with the Contest.
Employees of USW Local 1944 are not eligible to enter or participate in the Contest.
USW Local 1944 shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to USW Local 1944 for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. USW Local 1944 reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2. CONTEST PERIOD.
The Contest entry period shall start on August 6, 2020, and end on September 15, 2020, after which time the Contest will be closed and no other entries shall be accepted.
3. HOW TO ENTER.
There is no purchase necessary to enter the Contest. Entries must be received prior to the end of the Contest Period to be eligible for entry.
Limit of one (1) entry per day per person for the Contest Period. Participants are encouraged to enter a new picture everyday, taken in a different location. However, several entries of the same picture everyday will be considered void.
All entries, including stories and photographs submitted in connection with the Contest entry (the “Work”), become the sole property of USW Local 1944 and will not be returned. Entries must be received prior to the indicated Contest Period entry deadline. Entries will be declared invalid if they are late or incomplete. No communication or correspondence will be exchanged with entrants except with those selected as Contest Winners.
If Work has been submitted by an entrant in connection with the Contest, each entrant agrees that USW Local 1944 may post the Work on USW Local...
So I got the official word from the company today that everyone will be coming back as planned. Surface will be back on the 20th and the mine will be back in the 26th or when ever there next shift is after that. The company will contact everyone to notify them. Hopefully this is the end of this. Sales look ok for the future.
**Another short update this week. The company will be calling back a few people for next week 7/13 but not many. We are getting closer to being fully staffed and back to near full production. The plan is still to have 100% of the workforce returned by 7/27.

Inactive months do not count towards your 3 clean months of attendance for a point reduction and they also do not count towards your 12 month rolling calandar. This means every month you are inactive lengthens for rolling calandar. We are encouraging members to reach out with questions regarding attendance and to request your attendance record to make sure it is accurate and you understand your points level.

Le 9 juillet 2020 - La Section locale a reçu une sentence arbitrale favorable le 29 juin 2020, qui a permis à un membre qui avait été congédié de reprendre son poste. Le dossier d’appel a été mené par Tamara Marshall, Représentante de la section locale. Historiquement, les avocats représentaient les membres de la Section locale lors des arbitrages. Les représentants de la section locale sont désormais formés pour pouvoir représenter nos membres à leur place.
« Tamara est la deuxième Représentante de la section locale à avoir arbitré une affaire en tant que conseillère juridique pour un membre, et la première à avoir gagné, a déclaré Donna Hokiro, Présidente par intérim de la Section locale 1944 du Syndicat des Métallos. Cela montre que notre nouveau système, où ce sont les Représentants de la section locale et non plus les avocats qui arbitrent les dossiers, fonctionne. La victoire de la consœur Marshall est capitale, c’est un exploit formidable pour notre Section locale. Nous avons gagné malgré l’assise financière et le pouvoir du cabinet d’avocat de la compagnie, ce n’est pas rien. Excellent travail Tamara, merci pour ton plaidoyer. »
Grief de congédiement
La Section locale 1944 a déposé un grief contre le congédiement d’un membre en février 2019 pour retard chronique. La section locale était d’avis que les retards du membre n’étaient pas fautifs et que son congédiement constituait une mesure disciplinaire excessive. L’arbitre a accepté la position de la section locale :
« La requérante est une employée avec beaucoup d’ancienneté ayant près de 29 ans de service, appréciée de ses pairs, qui dispose d’un bilan de performance positif, à l’exception de son retard et de quelques absences. […] Elle a consacré la majeure partie de sa vie professionnelle au service de l’employeur. La sanction infligée pourrait lui infliger de graves difficultés économiques. »
L’arbitre a accepté le grief et le membre est retourné au travail le 6 juillet.
En coulisses : le travail nécessité par un arbitrage
La consœur Tamara Marshall est Représentante de la section locale depuis 14 ans. Elle a participé à de nombreux arbitrages et s’est formée par le biais de ses collaborations avec des conseillers juridiques. La préparation d’un arbitrage nécessite de rechercher et préparer la jurisprudence, rencontrer la partie plaignante, échanger de nombreux appels avec le conseil juridique de l’employeur, et assister à de multiples conférences préparatoires avec le conseiller juridique de l’entreprise et l’arbitre.
« Jusqu’à présent, les arbitrages auxquels se présentait la Section locale 1944 impliquaient un avocat pour chacune des parties ; je me sentais donc un peu comme une profane face à un avocat expérimenté », a déclaré Tamara Marshall.
