USW Local 2-1010 – Graphic Packaging – Kalamazoo, MI – Incompetence

The employer discharged the grievant incompetence – cutting a strap on a roll with a blade, cutting a wire that resulted in $25,000 damage. Only supervisors were supposed to cut straps, and were supposed to use scissors. It was the fifth violation in 12 months, three had been for carelessness. The grievant could not contradict the employer’s assertion that he should have known the SOP. The grievant was attempting to bid into a position that represented a demotion right before he was fired. The grievant’s inability to do the job should have figured into his job bid. Award: split – discharge converted into a demotion without backpay.
