LMP Update #3

As you are aware, we did not reach an agreement for a LMP.  The Company has implemented their plan which includes a VLO.  The Union did NOT agree to the rules placed within this voluntary layoff and we disagree with the Company’s interpretation of our Sub-pay language outlined in our BLA. We will be challenging it through the grievance procedure.  

If you do elect to sign, please be aware of Paragraph 3 of the VLO form which states, “I understand that the special Federal Pandemic Unemployment Compensation (FPUC) of $600 per week will be considered part of the state unemployment benefits for purposes of the Supplemental Unemployment Benefit (SUB) Offset which may fulfill all obligations for SUB.”  As long as the FPUC $600 is in the calculation, you are waiving your contractual right to sub-pay including the $250 minimum. (Please see the example chart below.)  

Also, once you sign up for a VLO, you will remain laid off for the duration or until you are recalled by the Company. You may not voluntarily return to work as you choose.

Before signing the VLO form, I strongly encourage you to speak directly with one of your Executive Board Officials or your Zone Griever.

The Company is in the process of replacing as many contractors as possible, including those preforming janitorial duties with displaced incumbent Employees in lieu of layoffs. Training to accomplish this is taking place this week.

The Company’s plan states:
“The amounts of SUB pay may be offset by the amount of unemployment compensation, which includes any Federal Pandemic Compensation (FPUC) Trade Adjustment Allowance and any excess other compensation you receive. If the difference between SUB pay and the offset is above $0 but less than $250, your total weekly SUB pay will be $250 per week.”

The Company is calculating the Sub Pay as Follows:40 times your continuous service percentage minus Unemployment benefits and FPUC which equals $990.
